Interpretation
The words with capitalized initial letters have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Acknowledgement
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and Me. By accessing or using the Service, You agree to comply with all legal and regulatory requirements for mobile messaging, including those established by the Campaign Registry (TCR) and U.S. mobile carriers, such as AT&T, Verizon, and T-Mobile.
By opting in to receive SMS or MMS messages, You acknowledge that:
- You will receive recurring messages related to Your purchase, transaction, promotions, or other Service updates.
- Message frequency may vary.
- Standard message and data rates may apply based on your mobile carrier’s plan.
Messaging Compliance
Opt-In Policy
By submitting Your phone number and opting into my SMS/MMS messaging service, You consent to receive promotional, transactional, or informational messages from Me. You are not required to provide consent as a condition of purchasing any goods or services from Me.
Opt-Out Policy
You may opt out of receiving SMS or MMS messages from Me at any time by replying "STOP" to any message You receive from Me. Upon receiving Your opt-out request, I will send one final confirmation message to confirm that You have been unsubscribed. After this, You will not receive any further messages unless You opt back in.
For help or customer support, You may reply "HELP" to any message, and I will provide You with assistance.
Mobile Carriers
I am not responsible for delays in messaging or message failures, as these are subject to carrier limitations. Delivery is subject to the capabilities of Your mobile carrier and may be affected by factors such as service interruptions or technical difficulties.
Placing Orders for Goods
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts and that all mobile communications related to the transaction comply with relevant laws, including those imposed by TCR and mobile carriers in the U.S.
Your information submitted in relation to any transaction may be shared with third-party messaging service providers solely for the purpose of managing mobile communications in compliance with TCR regulations and ensuring lawful messaging practices.
Availability, Errors, and Inaccuracies
I strive to maintain accurate information regarding pricing, availability, and descriptions of Goods. However, mobile messaging services may experience delays, inaccuracies, or errors, particularly with respect to carrier-related issues. I assume no liability for issues arising from messaging inaccuracies or interruptions.
User Accounts
When You create an account with Me, You agree to provide accurate, complete, and current information, including Your mobile number for messaging purposes. Any changes to Your mobile number must be reported promptly to ensure compliance with mobile carrier regulations and to avoid disruption in service.
Limitation of Liability
My liability for any damages resulting from mobile messaging services shall not exceed the lesser of the total amount paid by You for services or $100. I am not responsible for any indirect, incidental, or consequential damages arising from mobile carrier delays, messaging failures, or interruptions in service.
"AS IS" and "AS AVAILABLE" Disclaimer
My mobile messaging service is provided "AS IS" and "AS AVAILABLE," and is subject to potential service interruptions, carrier delays, or technical issues beyond my control. I make no warranties regarding the uninterrupted or error-free operation of messaging services, which are dependent on third-party carriers.
Governing Law
These Terms shall be governed by the laws of the United States. All messaging activities, including but not limited to SMS and MMS communications, will adhere to U.S. Federal Communications Commission (FCC) and Federal Trade Commission (FTC) guidelines, as well as any state or local laws that apply.
Changes to These Terms and Conditions
I reserve the right to modify or replace these Terms at any time to maintain compliance with applicable TCR and mobile carrier regulations. Any significant changes to my messaging services or terms will be communicated to You via SMS/MMS with at least 30 days' notice.
